Terms of Service - Smart Attendance

These Terms of Service govern your use of the Smart Attendance application ("the App") provided by Goldwind ("we", "our", or "the Company"). By accessing and using Smart Attendance, you accept and agree to be bound by these terms.

Acceptance of Terms

By accessing and using the Smart Attendance application, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.

Description of Service

Smart Attendance is a time tracking and attendance management application provided by Goldwind for employees and employers. The App includes punch-in/out functionality, location verification, photo capture for identity verification, and reporting features.

User Responsibilities

As a user of Smart Attendance, you agree to:

• Provide accurate and truthful information
• Use the App only for legitimate attendance tracking purposes
• Maintain the security of your account credentials
• Comply with your employer's attendance policies
• Not attempt to circumvent location or identity verification measures

Privacy and Data Collection

Your use of Smart Attendance is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as outlined in our Privacy Policy.

Permissions and Device Access

Smart Attendance may request access to certain features and data on your device to provide its services:

• Location Services: Required for attendance verification and punch-in/out functionality
• Camera: Required for identity verification through selfie capture during punch operations
• Contacts: Optional permission that allows you to invite colleagues to use the app. Contact information is accessed only when you choose to invite someone and is never stored, uploaded, or shared with third parties. You can use the app's invitation feature without granting contacts permission by using direct share options.
• Storage: Required for storing profile pictures and attendance records locally
• Notifications: Used to send attendance reminders and important updates

All permissions are requested at the time they are needed, and you can manage or revoke these permissions at any time through your device settings. Some features may not function properly if required permissions are not granted.

Invitation and Referral Features

Smart Attendance includes features that allow you to invite colleagues to use the app:

• You may invite others through various sharing methods including WhatsApp, SMS, email, or other messaging platforms
• If you choose to use the contact picker feature, you grant temporary access to your device contacts solely for the purpose of selecting recipients for invitations
• Contact information accessed through the invitation feature is processed entirely on your device and is never transmitted to our servers or third parties
• You are responsible for ensuring you have the right to share invitation messages with the recipients you select
• Invitation features are provided for convenience and are entirely optional

Acceptable Use

You may not use Smart Attendance to:

• Violate any applicable laws or regulations
• Impersonate another person or provide false information
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to other accounts or systems

Service Availability

Goldwind strives to maintain high availability of Smart Attendance, but we do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or other operational reasons.

Limitation of Liability

To the maximum extent permitted by law, Goldwind shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Smart Attendance.

Changes to Terms

Goldwind reserves the right to modify these terms at any time. We will notify users of significant changes through the Smart Attendance application or via email. Continued use of the App after changes constitutes acceptance of the new terms.

Termination

Goldwind may terminate or suspend your access to Smart Attendance at any time, with or without cause, and with or without notice, for conduct that we believe violates these terms or is harmful to other users or our business.
